Questions and Answers

Q: My spouse is telling me I must move out of our home. Do I have to?

A:

No. You do not have to move out. Unless and until your spouse gets a court order granting him or her exclusive possession of the home, you have the same right to live in the house as he or she does. Please call Michael Craven to discuss your case with you.

Q: Will my spouse be required to keep me on his/her health insurance after our divorce?

A:

If you or your spouse is covered under the other’s health insurance coverage, it will terminate when you are divorced. You may obtain a continuation of the coverage under a federal law commonly referred to as COBRA. There is a time limit for how long you are eligible for COBRA coverage, but under no circumstance does it exceed 36 months. Please call Michael Craven to discuss your case.

Q: Should I cancel my spouse's health insurance when I file for divorce?

A:

In most cases, you should not cancel your spouse’s health insurance if they are covered by your plan. If you terminated your spouse’s insurance before you are divorced and a medical expense is incurred, it will likely be considered a marital obligation that you can be held responsible for. Please contact Michael Craven to discuss your case with you.

Q: Can I date before the divorce is final?

A:

Q: Can a child decide which parent he or she will live with at a certain age?

A:

No. A minor child (a child who has not attained age 18) cannot decide which parent he or she will live with. However, the wishes of a child is one of several factors a court must consider when determining with whom the child will live with. As a general rule, the older the child, the more weight will be given to the child’s wishes. Please contact Michael Craven to discuss your case with you.

Q: Does adultery affect who gets custody?

A:

No. These are separate issues with no legal connection. The law expressly states that a court shall not consider conduct of a present or proposed custodian for a child that does affect his or her relationship with the child. Please contact Michael Craven to discuss your case with you.

If he says he's going to do something he does it without you having to remind him. Kept me informed during my entire case and explained difficult legal terms in a way I could understand. Michael Craven is a good man and a great lawyer.

Firstly, Michael was always available when I needed him. He helped me with a complicated situation that involved the courts and a false allegation directed towards me and my family. Secondly, as a newbie to the court system, Michael was very thorough and diligently guided me through the process. This provided me with much needed calmness and reassurance. Thirdly, even though there was a lot of information to comb through and understand, Michael was patient and believed in me. I felt like he was in my corner and I trusted him. His approach to my situation involved clarity, honesty and most of all my best interests. He based his analysis on facts and evidence and was able to help me and my family separate out the emotions. He communicated very clearly and prepared me for different kinds of scenarios and outcomes. His detailed analysis, thoroughness and attention to detail was very reassuring to me. I felt very confident going into our court date. Michael’s vast experience, knowledge of the law and expertise was instrumental in the handling of my case. I would highly recommend him to anyone who needs someone to really stand up for them.
